Legal
Returns
Information on the consumer’s right of withdrawal, on discretionary returns and on the handling of damaged or non-conforming goods.
Three distinct situations
This page distinguishes three cases, which do not coincide:
- Legal withdrawal: the consumer’s right to end a distance contract within the legal time limit, without having to give reasons;
- Discretionary return: a possible return accepted by the seller outside legal withdrawal, if and to the extent the seller agrees;
- Damaged or non-conforming goods: remedies provided by law in the case of a defect, damage or lack of conformity, distinct from withdrawal.
Right of withdrawal
For B2C distance sales, the consumer has 14 days to notify withdrawal. For goods, the period generally runs from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
Withdrawal is notified without any particular formality. An unequivocal statement is enough, for example by email to info@cantinesciacca.it.
Notices of withdrawal may also be sent to the registered office:

Return of the goods
After notifying withdrawal, the consumer returns the goods within the time limit provided by law for the return shipment.
The direct cost of the return is borne by the consumer, unless the seller has agreed otherwise or the applicable law requires otherwise.
Refund
In the case of withdrawal, the refund follows the rules of law. Payments received for the goods covered by the withdrawal are refunded, including the delivery costs, except as follows.
Delivery costs additional to the least expensive standard delivery method offered by the seller do not have to be refunded, where the law allows it, if the consumer chose a method other than the least expensive one.
The seller may withhold the refund until the goods have been received, or until the consumer proves that they have been sent, where the law allows it.
Diminished value
The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exceptions under the law
The exceptions to the right of withdrawal provided by article 59 of the Codice del Consumo apply only where the legal requirements are in fact met. This page does not declare a general exclusion of withdrawal for every purchase of wine or alcoholic drinks.
Discretionary return
Outside legal withdrawal, a return may be considered by the seller on request. There is no automatic 30-day returns policy, and no further right beyond what the law or an express agreement provides.
For a request of this kind, write to info@cantinesciacca.it.
Damaged or non-conforming goods
If the parcel arrives damaged, incomplete or not in conformity with the order, the customer is invited to report it promptly to info@cantinesciacca.it, describing the problem and, where useful, attaching photographs. These cases are handled under the legal protections on the conformity of goods, not as a withdrawal.
Alcoholic drinks
The rules on sale and delivery to adults set out in the Terms of sale and on the Shipping page remain in place.
